Derrick Rose Gets First Win Of The Season, Found Not Liable In Civil Rape Case

Derrick Rose, the 2011 Most Valuable Player in the NBA and the newly acquired New York Knick, has been under fire for alleged rape charges. What Rose and a couple of his friends refer to as a night out in Hollywood is referred to as the accuser’s attorney as a classic case of gang rape, that in which the trio have no remorse for.

The former ex-girlfriend claims that Rose and his two friends got her drunk and maybe even drugged her at a Beverly Hills home in 2013, later to gang rape her at her Los Angeles apartment. On the last day of testimony, there was heated debate over a vibrantly explicit text from the same year.

“If my flaw is wanting and waiting and keeping my p—y for you, then my bad.I can share u with howeva many b—–s.”

The three men never denied having sex with the woman, they just argued that it was all consensual. They also claim that the allegations weren’t brought up until after Derrick Rose broke up with her and tried to move on. His lawyers made it seem like a case of revenge and a girl with a broken heart looking for a pay day.

The jury was considering three claims to determine liability: sexual battery, batter and trespass. The accuser had to show that she was unable to consent because of her intoxication AND that the defendants didn’t reasonably believe that she could possibly be consenting. (I don’t make these laws)

The Knicks new point guard and his two friends have been cleared of all charges as of Wednesday, October 19th. The eight person jury decided that neither Derrick Rose nor his two childhood friends/current employees and co-defendants in this case were liable for sexual assault. This was a civil case. The accuser, Derrick Rose’s ex-girlfriend was seeking as much as $21.5 million dollars in damages, although her attorneys had loosened their demands in recent days saying that the jury could determine what they thought was a fair amount.

The jury didn’t take long to decide that she would be owed nothing, like Derrick Rose’s attorney suggested. It took just a few hours of deliberations to determine that the trio were not liable. And when it was all said and done jury members were taking pictures with Derrick Rose in front of the court house.

It should be noted that Los Angeles law enforcement can still file criminal charges against the trio, because the accuser did file a police report after the incident happened, but it’s not likely that they would pursue a case if she couldn’t convince a jury with this first chance in court. The official word from officials is that they are still accessing the facts of the case.

The accuser does have 30 days from the date the court enters the judgment for defendants, which will be after the post-trial motions to file an appeal. If she does decide to go forward with an appeal Derrick Rose would not have to testify or get involved at all, as everything can be handled by his lawyers from here on out. So it doesn’t look like he would need to miss any more playing time because of this case.

In the mean time it looks like Derrick Rose can return to a normal basketball life and put this whole ordeal behind him. “I am thankful that the jury understood and agreed with me,” Rose said in a statement to The Associated Press. “This experience and my sensitivity to it was deep. I am ready to put this behind me and focus on my family and career.”

New York Knicks head coach Jeff Hornacek said that he prefers to sit Rose for the final preseason game against the cross-bureau rival Nets, a game which will be played just one day after the jury decision. Although Rose has missed a majority of the team’s practices and every preseason game he is to start in the season opener against LeBron James and the defending champion Cavaliers next week.
